WWE Doctor vs. CM Punk & Colt Cabana Trial: The Verdict is In!

Dr. Chris Amann, WWEs senior ringside physician, may have lost more than a court case when a jury found for CM Punk and Colt Cabana in the defamation suit he brought against the pair for their 2014 podcast discussing Punks time in WWE.

 

During the trial, Amann may succeeded in raising some doubt about Punks version of events, even if it wasnt enough to win him a decision. But if his goal was to restore his repuation? Evidence definitely pointed to the doctor discussing patient information via text, violating HIPAA privacy regulations, and poor record-keeping, incuding dispensing medication without documentation. As if those missteps werent damaging enough, reporting from David Bixenspan for Deadspin points to a serious ethical violation which Amann himself confirmed in pre-trial depositions. And WWE doesnt seem to be happy about it.

 

Defense questioning during depositions revealed Amann had a romantic and sexual relationship with former WWE Superstar Jillian Hall. The timeline for that relationship, which the doctor confirmed, points to it going on while Hall was assigned to Raw and Amann was the lone doctor for the brand - meaning she was technically his patient.

 

Hall confirmed the relationship to Deadspin, which was also discussed in two other depositions from Cliff Compton and Punks sister Chaleen Rumpf. Though not documented as extensively, the defense also questioned Amann about another romance he had with an independent wrestler who tried out for WWE twice.

 

As Bixenspan was told by NYU medical ethics professor Arthur Caplan, these types of relationships with patients are a huge ethics no-no. Sex and romance distort objectivity, meaning a patient could tell a doctor what they think they want to hear rather than being honest about their condition, or doctors could be more willing to prescribe medications to please the patient. A doctor is also an authority figure, meaning their are tricky power dynamics involved. All of the codes of ethics say Dont do it, Caplan said.

 

None of this was introduced at trial as Amanns legal team filed motions to exclude it. Somewhat ironically, those motions are what led Bixenspan to the depositions, which were not sealed.

 

Perhaps worst of all for Amann, whose WWE contract Wrestling Observer says expires in October of this year, is that his bosses say they didnt know about his relationship with Hall. And when Deadspin asked them for comment, they werent happy:

 

We were not aware of this. We are investigating the matter and will determine if any action is warranted.

 

Caplan said that even though Amanns WWE bosses may not have been medical professionals, if they knew about his personal relationship with Hall, they would have had an ethical responsibility to end the doctor/patient relationship - something they could have done at the time by switching one or the other to the SmackDown brand.

 

One thing all of this does, at least for this writer, is call into question the notion WWE secretly backed Amanns lawsuit against Punk and Cabana. Vince McMahons legal team is adept at not only winning cases, but keeping them from getting far enough to where embarrassing information such as this comes to light.

 

Thats just supposition, however. It doesnt require a lot of guesswork to think this whole thing didnt work out the way Amann planned, though.

Colt Cabana Suing CM Punk For Over $1 Million

Colt Cabana (Scott Colton) is suing CM Punk (Phillip Brooks) over legal fees related to their recent defamation lawsuit win over WWE's Dr. Chris Amann, according to a report from The Chicago Sun Times.

 

Cabana has filed a lawsuit against Punk in Cook County Circuit Court for breach of contract and fraud.

 

Colt's suit alleges that Punk promised to help him out with the legal bills from the defamation suit. Colt claims Punk told him that he would be "100% covered" in a text message. Punk has allegedly failed to keep that promise and Colt now has unpaid legal bills totaling $513,736. Punk asked Colt to pay half of the legal fees, which would be $256,868, allegedly saying, "You are on your own."

 

The lawsuit claims, "Brooks acted with fraud, malice and oppression toward Colton, with the deliberate intention of causing Colton harm."

 

Colt is asking for $200,000 in general damages, plus $1 million in punitive and exemplary damages, according to the lawsuit filing.

 

Colt and Punk were good friends for years and courtroom reports from the recent trial with Amann indicated that they were back on good terms. It's worth noting that they started out with the same legal team for the case against Amann but Colt did hire his own attorneys. The two had a falling out in 2016 but Colt said in a June 2018 interview that they were cordial, but he hesitated before saying they are still friends.

There are always two sides of a story but damn, it doesnt look good for Punk there.

 

Caban was just a bystander so to speak and was dragged into this mess, he didnt had the money punk has made and not the name to do something like this lightly.

Yet he stood at punks side on this one till the end despite all this.

 

Punk now turning his back on him looks really awful.

Even if you use the whole "cabana was backstage at nxt a year or so ago" as reason, Punk didnt seem to have a problem with cabana backin him up during the trial.

 

Punk bought mercury a house so money doesnt seem to play a huge role when it comes to his friends, which tells you where he and cabana stand.

Its a dirty situation either way.

I mean, they had to pay a bunch of money and waste their times and were considered innocent, how is that fair that they still have to pay? That just opens up the door for rich bullies to abuse the legal system. Which is pretty much all this was.

Amann would have to pay them in England and probably all of Europe. The US is always a special case

A lot of big companies drag it on forever to make the other party drop out due to legal fees and "win" by default. WWE was trying to do this here but Punk persisted and won.

 

Still gotta pay legal fees tho, cuz 'merica

Colt ended up getting a separate legal team during the trial. Was that due to Punk not helping him pay for the legal team or is Colt trying to say Punk should help pay for the separate team too. Theres more to this story and with Punk, we are probably going to only hear one side and speculate the other.

Shame on punk if true, but there is always two sides to a story, maybe Punk only agreed to pay for the lawyers when they had the same ones, and doesn't feel like he owes him once he got different lawyers. (from understanding usually when a person wins a case, here they can in fact have their lawyers request they pay the lawyer fees, they might not have done that)

To conjure up a situation where Punk is justified for not keeping his promise, it's saying to Colt he'd have him covered, only for Colt to go way out of line and get legal assistance that he really didn't need. Like telling someone you'll pay for the food and he orders the most expensive *censored*ing thing on the menu. Thrice.
